A. Agreement

This End-User License Agreement (“EULA” or “Terms”) is a legal agreement between you and Jazz Games (“Jazz Games”, “we”, “us”, or “our”) for the Kera mobile application and related services (the “App”). By installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.

We may update these Terms from time to time. Material changes will be communicated by reasonable means (including in-app notice). Continued use after changes means you accept the updated Terms. Questions: hello@jazzgames.net.

Use of the App is also subject to our Privacy Policy, which is incorporated by reference.

B. Age requirement

You must be 13 years of age or older to install or use the App. If you are at least 13 but under 18, have a parent or legal guardian review these Terms with you and install the App for you. By allowing a child to use the App, a parent or guardian agrees to these Terms on the child’s behalf.

C. License

Subject to these Terms, Jazz Games grants you a limited, non-exclusive, revocable, non-sublicensable, non-transferable license to download and use the current version of the App on a device you own or control, solely for your personal, non-commercial use.

D. Restrictions

You may not rent, sell, lease, sublicense, distribute, or transfer the App; reverse-engineer, decompile, or modify it (except where applicable law allows); interfere with its security or operation; or use it for unlawful purposes. All rights not expressly granted are reserved by Jazz Games and its licensors.

E. Lifestyle hair care — not medical advice

Kera provides lifestyle hair-care suggestions, routines, and informational insights based on information and photos you choose to provide. Kera is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified professional for health concerns. Do not disregard professional advice because of something you read or see in the App.

F. Purchases & subscriptions

Certain features may require a paid subscription or in-app purchase processed by Apple, Google, or another platform. Payment terms, renewals, trials, and refunds are governed by the platform’s terms as well as any purchase screen shown to you.

• Subscriptions may auto-renew unless cancelled in your Apple ID or Google Play account settings according to platform rules.
• Free trials, if offered, convert to paid subscriptions unless cancelled before the trial ends as required by Apple or Google.
• EU residents: cancellation and refund rights for digital purchases may be limited once download or delivery begins; review the store’s policies before purchasing.

G. Updates & access

We may add, change, or remove features. The App may communicate with our servers and may require updates. You are responsible for your device, connectivity, and any carrier charges. We do not guarantee the App will work on every device, network, or language.

H. User content

You are responsible for photos and other content you submit. You must have the rights to use that content. You grant Jazz Games a license to process and use submitted content as needed to operate and improve the App (including analysis and support), consistent with the Privacy Policy. We may remove content that violates these Terms or applicable law.

I. Intellectual property

The App — including design, text, graphics, software, and branding — is owned by Jazz Games or its licensors and protected by intellectual property laws. “Kera” and related marks are property of Jazz Games or its affiliates. You may not use our marks without prior written consent.

J. Third-party services

The App may rely on third-party services (for example analytics, cloud infrastructure, AI analysis, and subscription validation). Those services are subject to their own terms and privacy policies. Jazz Games is not responsible for third-party websites, content, or services.

K. Disclaimer of warranties

TO THE EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

L. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, JAZZ GAMES AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR ACCESSING THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM.

M. Termination

Your rights under these Terms end automatically if you fail to comply with them. We may suspend or terminate access to the App at any time. Upon termination, stop using the App and delete copies in your possession. Sections that by their nature should survive will survive termination.

N. Governing law

These Terms are governed by the laws applicable to Jazz Games’ principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply. If any provision is unenforceable, the remainder remains in effect.
